1. About these terms
These Terms of Service are an agreement between you and Managetx.com Inc., which does business as Manage TX and Manage Texas ("Manage TX", "we", "us"). They cover the services we provide online:
- managetx.com, including the leasing inquiry form;
- the tenant portal at managetx.com/portal, and the pages we link to from our emails, such as the pages to pay a bill, view a charge, follow a work order or set up AutoPay;
- our text messages and emails to tenants; and
- the Manage TX mobile app used by our staff and contractors.
Together we call these the "Services". By using them, you agree to these Terms and to our Privacy Policy, which explains how we handle personal information.
Your lease comes first. If you are a tenant, your lease is the agreement that sets your rent, charges, due dates, late fees and other obligations. These Terms do not change your lease. If anything here conflicts with your lease, your lease controls.
2. Using our services
You must be at least 18 years old to use the Services. If you use them for a business, such as a company that leases space from us, you confirm that you are allowed to act for that business, and "you" includes that business.
When you use the Services, you agree to:
- give us accurate information and keep your contact details up to date;
- keep your sign-in codes and personal links private. The links in our emails, such as a Pay or AutoPay link, are made for you, so please don't forward them;
- tell us promptly if you think someone else has used your access or a payment you didn't make has gone through; and
- use the Services only for their intended purpose, and not try to break, overload, copy, scrape or get around the security of any part of them, or use them to send anything unlawful, harmful or abusive.
3. The tenant portal
Tenants and people who act for a tenant can use the portal to see their balance and account history, pay, set up AutoPay, send maintenance requests, book amenities and read notices from us. You sign in with a one-time code that we email to the address we hold for you.
We work to keep the portal accurate and up to date, but it is a convenience. If the portal ever differs from your lease or from our official account records, the lease and our records control. If something looks wrong, tell us and we will look into it.
4. Maintenance requests and emergencies
In an emergency that puts anyone's life or safety at risk, such as a fire, a gas smell, flooding or a medical emergency, call 911 first. Then let us know. Don't rely on the portal, a text message or an email to report an emergency, because those can be delayed.
You can report maintenance issues through the portal, by email, or by text message once texting is available on our number. We read requests and respond as quickly as we reasonably can, but sending a request doesn't guarantee a repair by a particular time. Access to your space for repairs and who pays for a repair are governed by your lease.
5. Paying online
Online payments are processed by Stripe, Inc., our payment processor. Card and bank details are entered on Stripe's secure pages, not on ours, and we never see your full card or account number. You can pay:
- From a bank account (ACH) with no fee. You can connect your bank by signing in to it through Stripe, or enter your routing and account numbers.
- By debit or credit card, with a card convenience fee of 3% of the payment. The fee is shown before you pay, and you can always avoid it by paying from a bank account.
Authorization. When you pay from a bank account, you authorize Managetx.com Inc., through Stripe, to debit that account for the amount you confirm and, if a debit is made in error, to credit it to put things right. Stripe shows you this authorization before you confirm.
When a payment counts. A card payment is usually confirmed within moments. A bank payment is shown as submitted until it clears, which usually takes about four business days. A payment is credited to your account as your lease provides.
Returned payments. If a bank payment is returned, or a card payment is reversed, it comes off your account and the amount is due again. Any returned-payment fee in your lease may also apply.
Other ways to pay, such as checks, still work as your lease and our office describe.
6. AutoPay
AutoPay pays your account automatically. You set it up from a personal sign-up link that we send you. Signing up doesn't charge you anything. You link a bank account (no fee) or a card (3% card fee) on Stripe's secure page, and Stripe records your authorization.
By turning on AutoPay, you authorize Managetx.com Inc., through Stripe, to charge the bank account or card you linked, on the payment day shown when you sign up, for the amount your account shows as due on that day. This authorization continues until you turn AutoPay off. Your account statement and the portal show what is due before each payment, and Stripe emails you a receipt after each one.
If an AutoPay payment fails, the amount stays due and our office is alerted. After two failed payments in a row, AutoPay pauses until it is set up again. You can pay another way in the meantime.
You can turn AutoPay off at any time from your AutoPay link or by contacting us. Turning it off stops future payments. To stop a payment scheduled for a particular day, turn AutoPay off at least one day before.
7. Refunds, disputes and cancellation
Refunds
Payments you make are applied to your account and are generally not refunded. But we will always fix a mistake:
- Duplicate or mistaken payments. If you pay twice, pay the wrong amount, or are charged in error, tell us. Once we confirm the mistake, we will refund the extra to the card or bank account it came from within 10 business days. A bank may take a few more days to show it.
- Overpayments. If you pay more than you owe, the extra stays on your account as a credit toward your next charges, unless you ask us to refund it.
- Card convenience fee. The 3% card fee isn't refundable, except when the refund is needed because of our mistake. Then we refund the fee too.
To ask for a refund, email info@managetx.com or call (817) 518-1380 with your name, the property and the payment date and amount.
If you disagree with a charge
Please contact us first. Most questions about a charge are answered quickly, and the pages we send for a charge show what it was for and let you reply. If you dispute a payment with your bank or card issuer instead, the amount remains due under your lease while the dispute is resolved.
Cancellation
You can stop AutoPay at any time, as described in section 6. There is nothing else to cancel. Using the portal is free, and you can simply stop using it. Ending or changing a lease is governed only by the lease.
8. Text messages
Texts are optional. We only text you if you opt in, in one of two ways:
- In the tenant portal. After you sign in, the portal asks "Can we text you?". If you tick the box and press Save, you agree that Manage TX may text the mobile number you give about your maintenance requests, work orders and account. You can change your answer at any time from the portal home screen. See exactly what the portal shows.
- By texting us first at (817) 952-6831, for example to report a maintenance problem. We reply to you about that request.
Giving us your phone number on a lease or as a contact does not sign you up for texts, and anyone who doesn't opt in gets the same service by email, by phone and in the portal. We don't send marketing texts.
- Message frequency varies with your requests and account activity.
- Message and data rates may apply, according to your mobile plan.
- Reply STOP to stop receiving texts at any time. We will send one message confirming that you've opted out. Reply START to opt back in.
- Reply HELP for help, or contact us at info@managetx.com or (817) 952-6831.
- Agreeing to receive texts is not a condition of leasing or of any purchase.
- Mobile carriers are not liable for delayed or undelivered messages.
We don't sell or share mobile numbers or text-messaging consent for anyone's marketing. See our Privacy Policy.
9. Email
We email tenants about their account, bills, work orders and building matters. When you reply to one of our emails about a work order, your reply is added to that work order's history and seen by the team working on it. You can ask us to stop non-essential emails, but we will still send messages we need to send under your lease.
10. The Manage TX staff app
The Manage TX mobile app is for our employees, and for contractors and vendors we authorize. It is not for the public. Accounts are created by us. If you use the app, you agree to:
- keep your sign-in to yourself and use the app only for Manage TX work;
- treat the tenant, property and financial information in it as confidential, and use it only as your work requires; and
- follow any instructions we give you about the app.
We may change, suspend or remove access to the app at any time. Your employment or contractor agreement with us also applies. To have your app account and its data deleted, see Deleting your app data.
If you downloaded the app from Apple's App Store, Apple is not a party to these Terms, is not responsible for the app or its content, and has no obligation to support it. Apple's standard terms for apps also apply to your use.
11. Other companies' services
Some parts of the Services rely on other companies:
- payments are processed by Stripe, under Stripe's terms and privacy policy;
- our staff use Plaid to connect our own company bank accounts for bookkeeping. Tenants are never asked to use Plaid.
We are not responsible for those companies' own services, websites or policies, or for their outages, although we will help you sort out any problem with a payment made to us.
12. Our content
The Services, including their design, text, graphics and software, belong to Managetx.com Inc. or to the companies we license them from. You may use them for their intended purpose under these Terms. You may not copy, sell or reuse them otherwise without our written permission. If you send us suggestions, we may use them without owing you anything.
13. Disclaimers
The Services are provided "as is" and "as available". To the fullest extent the law allows, we make no warranties about them beyond those in your lease, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement. We don't promise that the Services will always be available, uninterrupted or error-free.
14. Limits on liability
To the fullest extent the law allows, Managetx.com Inc. will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, arising from your use of the Services. Our total liability for any claim about the Services is limited to the greater of $100 or the card convenience fees you paid through the Services in the 12 months before the claim.
These limits apply only to the online Services. They don't change what you or we owe under a lease or any other written agreement between us, and they don't apply where the law doesn't allow them.
15. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. If you have a concern, please contact us first and give us 30 days to try to resolve it informally. If we can't, any legal action about the Services must be brought in the state or federal courts located in Denton County, Texas, and you and we agree to those courts' jurisdiction. Disputes under a lease are resolved as that lease provides.
16. Changes and ending access
We may update these Terms as the Services change. When we do, we'll change the "last updated" date above. If a change materially affects you, we'll tell you directly, by email or in the portal, before it takes effect. If you keep using the Services after a change takes effect, you accept the updated Terms.
We may suspend or end your access to the Services if you misuse them or break these Terms, or when you are no longer a tenant, contact, employee or contractor. Sections 7, 12, 13, 14, 15 and 17 continue to apply after your access ends.
17. General
These Terms, our Privacy Policy and, for tenants, your lease are the whole agreement about the Services. If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't waived it. You may not transfer your rights under these Terms. We may transfer ours, for example if we sell a property or the business.
